These Terms & Conditions ("Terms") govern your access to and use of the mobile applications Hug Talk and Chat Talk (the "Apps") and the related website, all owned and operated by Sazion IT Solutions ("Company", "we", "us", "our"). By downloading, registering for or using the Apps, you agree to be bound by these Terms. If you do not agree, please do not use the Apps.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering into a binding contract to use the Apps. By using the Apps, you confirm that you meet these requirements.
2. Your Account
- You must provide accurate and complete information when you register and keep it up to date.
- You are responsible for maintaining the confidentiality of your login details and for all activity under your account.
- You must notify us immediately at info@chattalk.co.in if you suspect unauthorised use of your account.
- One person may not maintain multiple accounts to abuse our services or promotions.
3. Acceptable Use
You agree not to use the Apps to:
- Post, send or share content that is unlawful, abusive, harassing, threatening, defamatory, obscene, sexually explicit, hateful or that promotes violence.
- Impersonate any person or misrepresent your identity or affiliation.
- Send spam, unsolicited promotions, chain messages, malware or harmful code.
- Exploit, harm or endanger minors in any way.
- Infringe the intellectual property, privacy or other rights of others.
- Attempt to hack, reverse engineer, decompile, disrupt or gain unauthorised access to the Apps, servers or other users' accounts.
- Use bots, scrapers or automated means to access the Apps without our written permission.
- Use the Apps for any illegal, fraudulent or deceptive purpose.
4. User Content
You retain ownership of the content you create and share through the Apps. By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, transmit and display that content solely to operate, provide and improve the Apps.
You are solely responsible for your content and the consequences of sharing it. We may remove content or restrict accounts that violate these Terms or applicable law, but we are not obliged to monitor all content.
5. Purchases, Subscriptions and Payments
Certain features of the Apps may be offered as paid services, in-app purchases or subscriptions. Prices are shown in the App before you buy and may change from time to time. Payments are processed by third-party platforms such as Google Play or the Apple App Store, and are subject to their terms.
Refunds and cancellations are governed by our Refund Policy and Cancellation Policy.
6. Intellectual Property
The Apps, including their design, software, logos, trademarks, text, graphics and features, are owned by Sazion IT Solutions or its licensors and are protected by copyright, trademark and other laws. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the Apps for your personal, non-commercial use. You may not copy, modify, distribute, sell or create derivative works from any part of the Apps without our prior written consent.
7. Privacy
Your use of the Apps is also governed by our Privacy Policy, which explains how we collect and use your information.
8. Third-Party Services and Links
The Apps may contain links to or integrations with third-party services. We do not control and are not responsible for their content, policies or practices. Your use of them is at your own risk.
9. Suspension and Termination
We may suspend or terminate your access to the Apps at any time, with or without notice, if you breach these Terms, misuse the Apps, or if required by law.
You may stop using the Apps and delete your account at any time as described in our Account Deletion Policy. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.
10. Disclaimer of Warranties
The Apps are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, uninterrupted or error-free operation, or that the Apps will be free from viruses or harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, Sazion IT Solutions, its directors, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of or inability to use the Apps. Our total liability for any claim shall not exceed the amount you paid to us, if any, in the three (3) months preceding the claim.
12. Indemnity
You agree to indemnify and hold harmless Sazion IT Solutions and its directors, employees and partners from any claims, losses, damages or expenses, including reasonable legal fees, arising from your breach of these Terms, your content, or your violation of any law or third-party rights.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Apps shall be subject to the exclusive jurisdiction of the courts at Kochi, Kerala, India.
14. Changes to These Terms
We may modify these Terms from time to time. Updated Terms will be posted on our Website with a revised "Last updated" date. Continued use of the Apps after changes means you accept the revised Terms.
